Defined Contribution Plans

Our Defined Contribution Plans are designed with your employees in mind.   In these turbulent times many employees spend considerable time worrying about their money and assets, diverting focus away from their work.

The sad truth is a majority of employees don't do anything. The Investment Company Institute found that 60% of all current 401(k) participants have never changed their original asset allocation from the day they first enrolled. Our plan allows employees the option of using a Registered Investment Advisor to manage their accounts according to their instructions. No more sleepless nights, using company time to track investment trends, and no more "201k" plans. Employees will have the comfort of knowing a true professional is watching over their nest egg every day.

Fiduciary Responsibilities


Did you know you may be held personally liable for losses in your company's 401(k) plan? The Supreme Court upheld ERISA section 409 in the case LaRue v. De Wolff (2008) which states, "Any fiduciary who breaches ERISA responsibilities, obligations or duties “shall be personally liable to make good to the plan any losses to the plan resulting from each such breach…”  If any one of the 20 requirements for a 404c compliant plan, Judge Harmon in her Enron ruling stated, "fiduciaries retain liability for all investment decisions made, including decisions by the Plan participants.”

We provide solutions past 404c requirements which provide wider fiduciary protection. Can you personally afford to not know your options?

Core Fiduciary Services:

  1. Serve as a co-fiduciary with the Trustee or Investment Committee of the Plan Sponsor.

  2. Assist in compiling or amending the Investment Policy Statement for the Plan via mail or web for the Plan to include the elements of the core program.

  3. Prepare and present to the Trustee or Committee via mail or web a selection of core funds, including appropriate asset classes and investment options, accessible by Self-Directing Plan Participant accounts.

  4. Review investment options as they relate to the criteria in the Investment Policy Statement, including an Ibbotson/Morningstar review of each mutual fund.

  5. Maintain a dedicated webpage featuring at least three Ibbotson Encorr asset allocation portfolios drawn from the core funds to support Self-Directing Plan Participants in making their investment decisions.

  6. Mail quarterly newsletters to identified Self-Directing Plan Participants.

  7. Provide access to two weekly market updates

  8. Support the Trustee or Investment Committee by being reasonably available to answer questions via mail, web or conference calls concerning the plan’s investment options.
